Practice Profile
Stuart has practised exclusively in Family Law from 1992 and has specialised in the financial aspects of divorce (and relationship breakdown) from 1998. His work is across a broad spectrum from the “heavy” case to the medium / modest asset case.
He has a particular interest in cases involving delay and inherited assets. Geographically, his work is mainly in London and the Home Counties. He also has work in Wales.
Recent cases of interest include:-
The representation of a wife in a long marriage case where her contributions to raising the parties’ adult daughter (who suffered from Cornelia de Lange syndrome) were so significant as to outweigh a 50% division.
A successful and early strike out application against a Husband where his case disclosed no reasonable grounds for bringing his application: FPR 2010, r. 4.4
The representation of a wife who had brought all the capital to a marriage of median duration. Part of the settlement for her included an obligation for the Husband to give her first refusal to purchase land that he was developing.
A successful settlement for a Husband involving the variation of an ante-nuptial settlement enabling him to retain the former matrimonial home.
He is presently instructed in the first case to reach the Courts concerning the powers of the Child Enforcement Maintenance Commission to apply to set aside a transfer of property under S.32 (L) (2) of the Child Support Act 1991. The final hearing of that case is awaiting a listing and it is likely to be reported.
The representation of a Husband whose financial position had deteriorated radically in the present economic climate and led to a substantial reduction in the rate of periodical payments (albeit the original order was made only 2 years before).
