Deirdre Fottrell QC and Thomas Wilson appeared in Re H (A Child: Surrogacy Breakdown), a decision of the Court of Appeal in relation to the arrangements for a child following the breakdown of a surrogacy arrangement.


The Court of Appeal confirmed that the law does not take a special approach to decisions about surrogacy breakdown or other disputes with unconventional family structures, but applies established principles to the facts before it. The Court of Appeal also repeated the trial judge’s warning that this case illustrates the consequences of the UK not having a properly supported and regulated framework to underpin surrogacy arrangements.
