Simon Sugar has contributed the first article in a two-part series on the topic of domestic abuse in financial remedy proceedings for Resolution's The Review.
Recent decisions have sugested that domestic abuse doesn't generally count as conduct in financial cases. But that does not remove it as an issue. This first part of a two-part analysis focuses on identificaiton of abuse in order to develop an effective litigation strategy. The second part of the article, which will appear in a future issue, will turn to litigation strategy.
