F v M (Disclosure to the First Tier Tribunal) [2026] EWHC 2171

Gemma Kelly, instructed by Freemans, represented the child in High Court proceedings where there was a dispute as to whether the judgment (F v M [2026] EWHC 239) from an earlier fact-finding hearing, at which Gemma also represented the child, should be disclosed into immigration proceedings.  

The Court ultimately permitted disclosure, placing significant weight on the wider public interest in ensuring informed decision-making across different parts of the justice system and promoting cooperation between courts and public bodies dealing with matters affecting children.

A key factor was some misleading correspondence about the progress of the Children Act proceedings which had been provided, which, although the judge made no finding as to intention, did not refer to the earlier fact-finding judgment and therefore left the Tribunal without the full procedural picture.
