Monica Young appeared on behalf of the respondent wife in a complex High Court case considering cross-border divorce and matrimonial proceedings in this jurisdiction and India.
The case included consideration of applications for anti-suit injunctions on both sides, as well as an application for an anti-anti-suit injunction, and the respondent wife’s interim arguments of forum non conveniens. Due to the technicalities and complexities, the case was heard by Mr Justice Poole in the High Court, who considered the case law, principles of comity, and availability of matrimonial remedies to the respondent Wife under the Hindu Marriage Act 1955.
