Henry Lamb and Jyoti Wood, instructed by Tony McGovern of Creighton & Partners, represented the child in Re LM (A Child: Return Order to the UAE; Humanitarian Protection [2026] EWHC 1988.
These complex proceedings in the High Court involved serious allegations of abuse, including of FGM and the application of international and immigration law to the powers of the High Court under the inherent jurisdiction. The father sought to rely upon his grant of Humanitarian Protection in the UK as a bar to the implementation of a return order. The court praised Henry and Jyoti for their extensive research and for their detailed and helpful skeleton argument. In closing submissions, Leading Counsel for the father conceded the point on the basis of the analysis of the law as set out in Henry and Jyoti’s skeleton argument.
This case is now the leading authority on this issue. In addition, the court acknowledged that important facts in the case had only emerged through the child’s team’s scrutiny of the evidence and the questions asked on behalf of the child.
